Your Right to Opt-Out of Sale and Sharing of Personal Information under the California Privacy Rights Act

Pursuant to the California Privacy Rights Act (CPRA) and the regulations enacted thereunder, you have the right to opt-out of the sale of personal information that Boxed has about you. Please read the below webform instructions carefully and select the appropriate responses to submit your request to opt-out of the sale of personal information to us for verification. Boxed does not disclose your personal information in exchange for monetary payment. However, we may disclose or provide access to personal information to certain third parties that provide us with services such as helping us with advertising, data analysis and security, which may fall under the definition of “consideration” and be considered a “sale” under the CPRA.

We will do our best to honor your request promptly and in any event will act on your request within fifteen days from the date we receive your submitted request.

Please note that the CPRA contains several exceptions to what constitutes a “sale” under and as defined in the CPRA, which exceptions have the effect of excluding certain personal information from this request to opt-out of the sale of personal information, including where Boxed uses or shares personal information (1) with a service provider to perform a business purpose in accordance with our CPRA disclosures and the service provider does not further collect, sell or use the personal information except as necessary to perform the business purpose; and (2) as an asset that is part of a merger, acquisition, bankruptcy or other transaction where a third party assumes control all or a part of the Boxed business, in any case, in accordance with the CPRA and other applicable law.

Future Opt-In to Sale or Sharing of Personal Information

Note that certain transactions may not be possible through the Boxed Sites following the successful processing of your opt-out of sale and sharing of personal information request. We will exercise commercially reasonable efforts to notify you where transactions require the sale or sharing of personal information to complete such transaction and offer you the ability to opt-in to the sale or sharing of personal information at that time.
